Case summary

On August 23, 2012, Region 5 filed a Consent Agreement and Final Order (CAFO) to resolve violations committed by Petro-Chem Processing Group of Nortru, LLC (Petro-Chem) related to exports of hazardous waste. In January 2009, Petro-Chem filed their required annual report of hazardous wastes exported in 2008. Office of International Compliance Assurance reviewed the report and concluded that if was probably inaccurate. They then referred the case to Region 5 for review.Region 5 applied the criteria of the RCRA Civil Response Policy to these two violations and proposed a penalty of $25,700 in a pre-filing letter sent to Petro-Chem on April 12, 2012. Petro-Chem did not dispute the violations and agreed to settle the case by paying a penalty of $23,130 (reduced by 10% for being cooperative) and reviewing subsequent annual reports and submitting corrected versions of these reports.
