Case summary
This enforcement action was filed in response to violations discovered during an EPCRA 311/312 compliance inspection which was conducted on 6/17/2009. During calendar years 2007, 2008, 2009 and 2011, LaGrou had sulfuric acid and lead on site in quantities equal to or greater than the EPCRA 312 reporting thresholds and had not submitted Tier II Forms to the SERC, LEPC and local fire department in a timely manner (i. e. by the March 1st reporting deadline for each of these years). Prior to settlement of this case, the company submitted financial information indicating an inability to pay any level of penalty. US EPA has agreed to mitigate the penalty to $0 based on LaGrou's inability to pay.
