Case summary

On 3/21/2012, Respondent disclosed the following violations: 1.) Failure to submit an MSDS for sulfuric acid to the Indiana SERC, the Cass County LEPC and the Logansport Fire Department within 90 days of when the chemical was first brought into the facility; 2.) Failure to submit Tier II forms for sulfuric acid to the SERC, LEPC and local fire department for calendar years 2009, 2010 and 2011 by the March 1st reporting deadline; 3.) Failure to notify the NRC and submit an initial written report to the EPA Regional Office regarding continuous releases of nitric oxide. The EPA has determined that Respondent has met the conditions for a 100% reduction in gravity-based penalties pursuant to the Small Business Compliance Policy and, consequently, will not seek any penalties.
