Case summary
On 5/25/2010, LTU disclosed multiple violations of the following regulations: CWA 311/SPCC, EPCRA 311/312, RCRA, TSCA and CAA/NESHAP. Based upon LTU's Disclosure and Final Compliance Report, the following penalties were calculated: $237,870 RCRA; $23,290 CWA 311/SPCC; $27,158 EPCRA 311/312; $43,170 CAA/NESHAP. The EPA concluded that LTU has satisfied each of the nine conditions set forth in the Self Disclosure Policy and that LTU did not obtain a significant economic benefit from its tardy compliance. Consequently EPA has decided to waive all penalties.
