Case summary
This enforcement action was filed in response to violations to EPCRA 311/312 which were discoverd during a site inspection conducted on 7/17/2008. It was discovered that McCook failed to submit a Tier II form for anhydrous ammonia and sulfuric acid for calendar year 2007. Subsequent investigation determined that McCook had more than 10,000 lbs. of lead in the form of lead-acid batteries on site during calendar years 2008, 2009 and 2010 and did not include lead on the Tier II forms submitted to the SERC, LEPC and local fire department.
