EPA v. ELITE FINISHING, LLC

Case summary

This CAFO commences and concludes an administrative enforcement action against Elite Finishing, LLC (Elite) for violations of the National Emissions Standards for Hazardous Air Pollutants for Chromium Emissions from Hard and Decorative Chromium Electroplating and Chromium Anodizing Tanks (the Chrome Plating NESHAP) at 40 C.F.R. §§ 63.340 through 63.348. These violations were identified by the Wisconsin Department of Natural Resources (WDNR), but EPA assumed the lead after WDNR was unable to resolve the violations in accordance with the High Priority Violators Policy. Specifically, in the period between July 1, 2007 and December 31, 2007, Elite exceeded the allowable surface tension in the electroplating bath on 22 occasions. According to the company’s semi-annual compliance report for the period, Elite reported a total of 100 hours of noncompliance. These exceedances resulted in excess emissions of Chromium (VI). The EPA issued a Finding of Violation (FOV) to Elite on March 8, 2012 for the violations. The parties held a conference to discuss the FOV on April 26, 2012. Elite is currently in compliance with the Chrome Plating NESHAP. Under this CAFO, Elite will pay a civil penalty of $15,000.
