EPA v. EXCEL FOUNDRY & MACHINE INC
Case summary
Excel operates a foundry which melts scrap metal and ingots to cast brass, bronze, steel, and iron parts. The cast metal is machined to create parts primarily for large mining equipment. The facility operates an air pollution control system to control emissions generated during melting, tapping and pouring. Excel is subject to Subpart ZZZZZZ, which requires implementation of work practice standards, and notifications to certify compliance. Excel has already implemented the work practices required by the NESHAP but was not aware that they needed to send an Initial Notification or a Notification of Compliance Status. This agreement sets deadlines for coming into full compliance with the NESHAP and adding a provision to their permit. They are eager to come into compliance and have agreed to the terms of this agreement.
