Case summary

The December 22, 2011 second Amended AO requires system to comply with the Combined Radium MCL of 5 pCi/L as soon as possible and no later than November 30, 2012; Submit to U.S. EPA and Illinois EPA a letter stating Respondent’s intention to comply within 10 days from receipt of this Order; Complete the following actions to bring the System into compliance with the Combined Radium MCL by completing a connection to the Village of Lewiston public water system: Advertise Bids by 2/10/12, Open Bids by 3/9/12,Loan Closing/Begin Construction by 5/18/12, and Complete Construction by November 30, 2012. The Amended AO also requires system to continue to follow current operation and maintenance procedures for the treatment process at the Village of Bryant public water system treatment plant as documented in Appendix 1 of this Amended Order, including immediately investigating increases in daily water usage, and promptly locating and fixing leaks until the Village of Bryant completes the connection to the Village of Lewiston public water system and discontinues use of its own well. It also requires system to continue to submit to U.S. EPA and Illinois EPA in writing, a progress report on the status of achieving each identified milestone by March 31, 2012, and by the end of each subsequent calendar quarter: sample quarterly for combined radium and provide public notice each quarter as long as the violations persists. Our records show that Bryant met the requirements of the 2011 Order by notifying U.S. EPA and Illinois EPA by letter dated January 2, 2012 of its intention to comply with the terms of the 2011 Order. On February 9, 2012, Bryant notified U.S. EPA by telephone that advertisement of bids would be delayed. On March 20, 2012, Bryant submitted a written request for extensions of the advertise bid date until March 25, 2012, open bid date until May 10, 2012 (because contract related items needed to be approved by the State Attorney General), and the closing/begin construction date until August 8, 2012. U.S. EPA approved this request on Mach 22, 2012. Bryant notified U.S. EPA by voice message on September 19, 2012, and telephone call on September 24, 2012, that Bryant’s engineering firm advised there would be a delay in delivery of the prefabricated pump station until December 2012. On October 5, 2012, Bryant submitted a written request for an extension of the complete construction date until December 31, 2012, which was approved by U.S EPA on October 9, 2012. On December 12, 2012, Bryant notified U.S. EPA that delivery of pre-fabricated pump station would be delayed until January 2013, and on December 14, 2012, Bryant submitted a written request for extension of the complete construction date until February 15, 2013. U.S. EPA approved this request on December 20, 2012. On February 15, 2013, Bryant submitted a request for extension of the complete construction date due to weather, and scheduling with local utility company to run power to the pump station and sub-contractor to run a start up on the pump station. On March 8, 2013, U.S. EPA granted Bryant an extension until March 31, 2013. On March 1, 2013, Bryant notified U.S. EPA that Bryant completed its connection to the Village of Lewiston water system on February 28, 2013. Our records also show that Bryant submitted a quarterly written progress report on the status of achieving each identified milestone as required in the 2011 Order. Our records also show that Bryant continued to monitor quarterly for Combined Radium, provide public notice quarterly as long as the violation persisted, and submitted all monitoring results and copies of public notices and public notice certification statements to U.S. EPA and Illinois EPA. Our records also show that Bryant has not exceeded the Combined Radium MCL since the third calendar quarter of 2011.
