Case summary
Rexair failed to submit an emergency planning notification under EPCRA 302/303 on or before 2/28/2007. This was discovered and corrected on 7/19/2011. Rexair also failed to submit MSDSs and Tier II forms for lead-acid batteries, hydraulic oil and dielectric fluids for calendar years 2006 thru 2011. Because of Rexair's willingness to self-police, disclose and correct violations in a timely manner, EPA has chosen not to seek $164,625 in penalties.
