Case summary
This CAFO alleges that Interstate Cold Storage failed to timely submit a completed emergency and hazardous chemical inventory (Tier II) form for ammonia and sulfuric acid for calendar year 2007 for two of its Fort Wayne facilities to the Indiana SERC, the LEPC and the local fire departments with jurisdiction over the facilities. Region 5 proposed a penalty of $154,869, which was reduced to $80,371 in consideration of the Respondent's good faith negotiations, cooperation, size of business and quick settlement.
