Case summary

Potters is a glass recycler which grinds scrap cut glass pieces into specific sizes, and softens them in furnaces to form glass beads. Potters is located in an Environmental Justice area. The U.S. Environmental Protection Agency issued two Notices of Violation to Potters on October 12, 2010 and March 11, 2011 for the aforementioned violations. EPA discovered these violations through an inspection it conducted on October 28, 2009; through Potters’ responses to EPA’s 114 Information Requests; and through results of PM stack testing conducted on November 29-30, 2010, as required by EPA’s 114 Information Request on October 13, 2010. In February 2011, Potters installed a leak detection system on the Unit P010 furnace baghouse as requested by EPA, and completed installation of a cover on the outside cullet pile in July 2011, again as requested by EPA. Potters is also seeking to reduce the PM emissions limit in its recently issued permit. Potters has demonstrated that it is in compliance with its permit requirements, and the parties have been able to reach a settlement. The CAFO requires Potters to pay a civil penalty of $20,000 and perform a Supplemental Environmental Project (SEP) at a cost of $50,000 (with a SEP value of $40,000). The SEP is a diesel retrofit project to be performed in the Cleveland, Ohio area.
