EPA v. COUNTRYSIDE GENCO LLC
Case summary
Countryside Genco, LLC. (Genco) operates a facility that generates electricity using engines that combust landfill gas from neighboring Countryside Landfill. Gencos sulfur dioxide emissions were discovered to have significantly increased after higher than expected concentrations of hydrogen sulfide were found to be present in the landfill gas. The elevated hydrogen sulfide levels found in the landfill gas was caused by the disposal of processed construction and demolition debris by Countryside Landfill. To come into compliance, Genco has applied to Illinois Environmental Protection Agency to modify their facilitys permitted sulfur dioxide levels. Genco has also agreed to an Administrative Consent Order, EPA-5-11-113(a)IL--06, where the facility undertake a regular monitoring program to assess the concentration of hydrogen sulfide in the landfill gas used by its facility, as well as a robust preventative maintenance program in order to decrease the potential for incidents where the facility would have to be off-line. To address the past violations, Genco has agreed to the terms of this CAFO that will require the payment of a $46,596 penalty.
