EPA v. ALUMINUM RECOVERY TECHNOLOGIES, INC.

Case summary

The NESHAP for Secondary Aluminum Production, 40 CFR Part 63, Subpart RRR. Aluminum Recovery Technologies, Inc. (ART) was to have conducted repeat performance testing at its two existing group 1 furnaces no later than August 2010. Although ART did test these group 1 furnaces in January 2011, the tests were not valid because, due to ambient temperatures, the baghouse inlet temperatures were too low to establish representative maximum baghouse inlet operating temperature values. ART wrote EPA requesting a “waiver” from performing repeat performance testing until 2015. EPA informed ART that this waiver cannot be granted and indeed the facility must perform repeat performance testing at the existing group 1 furnaces during the summer months in order to establish representative maximum baghouse inlet operating temperature values. This Administrative Consent Order requires additional performance testing be performed by September 1, 2011.
