Case summary

On May 8, 2009, EPA issued a Findings of Violation to Gebauer Company (Gebauer) for violating the ban on nonessential products containing a Class I controlled substance, at 40 C.F.R. § 82.64. Gebauer sold or distributed Gebauer’s Fluro-Ethyl and Gebauer's Fluori-Methane in interstate commerce, or offered Gebauer’s Fluro-Ethyl and/or Gebauer's Fluori-Methane for sale or distribution in interstate commerce after the ban was implemented. As part of the settlement documented in the CAFO, Gebauer will cease production of the two products and contact its distributors to recall any remaining product remaining in stock. ThE CAFO also requires Gebauer to pay a civil penalty in the amount of $75,804.47.
