Case summary

During WTI’s performance test occurring on March 30 and 31, April 1 and 2, and May 11 and 12, 2010, the average dioxin/furan emission concentration was 0.512 nanograms toxic equivalent per dry standard cubic meter corrected to 7 percent oxygen (ng TEQ/dscm @ 7% oxygen), and the average mercury emission concentration was 290.7 micrograms per dry standard cubic meter corrected to 7 percent oxygen (ug/dscm @ 7% oxygen). The dioxin/furan emission standard is 0.20 ng TEQ/dscm @ 7% oxygen, and the mercury emission standard is 130 ug/dscm @ 7% oxygen. During WTI’s subsequent performance test on September 15 and 16, 2010, the average dioxin/furan emission concentration was 0.0086 ng TEQ/dscm @ 7% oxygen, and the average mercury emission concentration was 7.04 µg/dscm @ 7% oxygen. After WTI received the preliminary results of the May 2010 test, WTI increased the injection rate for activated carbon at one of the two locations. WTI avoided the cost of buying more carbon than before the May 2010 test. However, WTI also avoided the expense of disposing the additional spent carbon. Consequently, the cost of WTI's direct actions to achieve compliance is unknown at this time. The Administrative Complaint proposes a $151,800 civil penalty.
