Case summary
On July 1 ,2010 the U.S. Environmental Protection Agency issued a Consent Agreement and Final Order (CAFO) under Section 113(d) of the Clean Air Act (CAA), 42 U.S.C. § 7413(d), resolving claims for federal civil penalties for alleged violations by The Newark Group, formally known as Wisconsin Paperboard, of CAA Section 112(d), and the regulations promulgated at 40 C.F.R. Part 63, Subpart JJJJ, §§ 63.3280-63.3420 (Subpart JJJJ). Wisconsin Paperboard failed to provide timely initial notification, semiannual compliance reports, and notification of compliance status as required by Subpart JJJJ, as set forth in a July 31, 2009 Finding of Violation. Respondent submitted the notifications and reports on September 30, 2008 and had returned to compliance before EPA commenced enforcement action. The action is resolved by payment of a cash penalty.
