Case summary
A Consent Agreement and Final Order was filed with the Regional Hearing Clerk on 3/16/10. This CAFO resolves violations of Section 404 of the CWA at two active mining operations owned by Solar Sources - Cannelburg and Lewis mines - located in southern Indiana. On 2/4/10 EPA public noticed a consent agreement and final order (CAFO) for Solar Sources in order to settle CWA 404 violations for discharges of fill and/or dredge material into several streams at its surface coal mines in Cannelburg and Lewis, in southern Indiana. The discharges at the Cannelburg mine impacted a total of 23,425 linear feet of stream. The discharges at the Lewis mine impacted a total of 9,381 feet of stream. The violations are of environmental significance because the activities resulted in a loss of aquatic habitat, a reduction in the overall stream length, decreased water quality, and negatively affected the biological integrity and biodiversity of the impacted watersheds. Solar Sources has agreed to pay a civil penalty of $299,500 to resolve these violations
