EPA v. Pulsar, Inc.

Case summary

On September 30, 2009, EPA issued a Complaint and Compliance order against Pulsar, Inc. (Pulsar). Based on findings from a June 19, 2008, Compliance Evaluation Inspection, and information provided to EPA by Pulsar, Pulsar was in non compliance with conditions for a hazardous waste storage permit exemption and in violation of several requirements, including; 1) storing hazardous waste on-site for greater than 90 days; 2) failure to properly label and date containers storing hazardous waste; 3) failure to train facility personnel on an annual basis and within 6 months of the date of employment or assignment to a position of hazardous waste management; 4) failure to meet all requirements of the contingency plan; 5) failure to store hazardous waste in a tank system with secondary containment or a leak detection system; 6) failure to store hazardous waste in a tank system with controls and practices in place to prevent spills; and 7) failure to inspect a hazardous waste storage tank system once per operating day.
