Case summary

Bremner Food Group, Inc. (Bremner) owns and operates a private label cookie manufacturing facility at 1450 Pate Plaza Drive, South Beloit, Illinois. In a Notice of Violation issued June 2, 2008, EPA finds that Bremner violated Section 110 of the Clean Air Act, 42 U.S.C. § 7410, and the Illinois State Implementation Plan. Specifically, Bremner failed to account for all potential emissions that could be emitted from its South Beloit, Illinois facility when applying for its construction and operating permits, in violation of 35 Illinois Administrative Code §§ 201.152 and 201.157. EPA discovered these violations after reviewing Bremner’s response to an information request and through an April 3, 2008 inspection of the facility. EPA is issuing the Administrative Penalty Order concurrently with this Consent Agreement and Final Order (CAFO). Bremner demonstrated compliance by applying for a revision of its lifetime operating permit on October 7, 2008. Under this CAFO, Bremner will pay a penalty of $20,310 and will perform the following supplemental environmental project: retrofitting one of its cooling units to use a non-ozone-depleting substance within 6 months of the effective date of this CAFO.
