EPA v. ST. CATHERINE HOSPITAL NOTICE OF DETERMINATION

Case summary

On April 9, 2009 and May 21, 2009, St. Catherine Hospital provided to the EPA a formal notification and voluntary disclosure that St. Catherine Hospital, in East Chicago, Indiana violated various environmental laws implemented and enforced by the EPA. Specifically, St. Catherine Hospital disclosed that it violated the National Emission Standards for Hazardous Air Pollutants, National Emission Standards for Hospital Ethylene Oxide Sterilizers, Subpart WWWWW, 40 CFR 63.10432, and Section 112 of the Clean Air Act, by failing to keep records, from December 29, 2008 until April 15, 2009, which demonstrated continuous compliance with the management practice standard found at 40 CFR 63.10390, for St. Catherine Hospital's ethylene oxide sterilizer. St. Catherine's has revised its record keeping systems and is now keeping the required records. St. Catherine Hospital also disclosed that it violated Section 312 of the Emergency Planning and Community Right-to-know Act (EPCRA) by failing to submit a complete Hazardous Chemical Inventory Form (Tier II), including diesel fuel, on March 1 of each calendar year through calendar year 2009, to the Indiana State Emergency Response Commission, the Lake County Local Emergency Planning Commission and the East Chicago Fire Department.
