Case summary
On April 9, 2009, May 19, 2009 and July 2, 2009, St. Mary's Medical Center provided to the EPA formal notification and voluntary disclosure that St. Mary's Medical Center, in Hobart, Indiana violated various environmental laws implemented and enforced by EPA. Specifically, St. Mary's Medical Center disclosed that it had violated New Source Performance Standards (NSPS), Standards of Performance for Small Industrial-Commercial-Institutional Steam Generating Units, 40 CFR 60.7 and 60.48c, and Section 111 of the Clean Air Act, by failing to submit notifications and semi-annual reports relating to Boiler No. 4 from June 13, 2007 until May 19, 2009; and the National Emission Standards for Hazardous Air Pollutants, National Emission Standards for Hospital Ethylene Oxide Sterilizers, Subpart WWWWW, 40 CFR 63.10432, and Section 112 of the Clean Air Act, by failing to keep records from December 29, 2008 until April 15, 2009, which demonstrated continuous compliance with the management practices found at 40 CFR 63.10390, for St. Mary's Medical Center's ethylene oxide sterilizer. In addition to the Clean Air Act violations, violations of the Emergency Planning and Community Right-to-Know Act (EPCRA) were also disclosed. Specifically, St. Mary's Medical Center disclosed failure to submit a complete Hazardous Chemical Inventory Form (Tier II), including diesel fuel, on March 1 of each calendar year through calendar year 2009, to the Indiana State Emergency Response Commission, the Lake County Local Emergency Planning Commission, and the Hobart Fire Department. For all violations, St. Mary's Medical Center submitted the required notifications and reports and implemented the required record keeping systems to comply with the regulations.
