Case summary
On September 15, 2008, and November 20, 2008, Rentech disclosed violations of 40 C.F.R. Part 82, Subpart F (the Stratospheric Ozone Protection regulations) at the East Dubuque Nitrogen Production Facility, #1 Nitric Acid Plant to EPA. Rentech failed to comply with the leak repair regulations of the Stratospheric Ozone Protection provisions of Section 608 of the Clean Air Act, 42 U.S.C. § 7471g. Specifically, following an internal audit, Rentech determined that it had failed to repair and retrofit leaking industrial process units as required by the Stratospheric Ozone regulations at 40 C.F.R. Part 82. Under the terms of the settlement in the Administrative Order, Rentech will replace the violating unit with a unit that uses Non-Ozone Depleting Substances.
