Case summary
A Notice and Finding of Violation was issued to BRCs Montpelier, Indiana facility on June 5, 2008, for violating the NESHAP for Surface Coating of Miscellaneous Metal Parts and Products at 40 C.F.R. part 63, subpart MMMM, and the Montpelier facilitys Title V permit. The violations stem from the source exceeding the NESHAPs limits on HAP emissions from the facilitys metal part manufacturing operations. To come into compliance, the facility conducted product testing and switched to coatings and adhesives containing lower amounts of HAP and VOC. To resolve the past violations, BRC will pay a penalty of $18,017 and complete a SEP valued at $82,450. BRC's SEP will increase the transfer efficiency of the facility's coating and adhesive application equipment. This will result in the reduction of the emission of a combined 25 tons of xylene, styrene, toluene and other VOC and HAP.
