Case summary
GE Plastics, now SABIC Innovative Plastics, submitted a self-disclosure notice in July 2007 for the Mt. Vernon, Indiana facility, which we received on August 8, 2007. Because the matters addressed in the notice appear to be related to the EPA findings set forth in the December 8, 2005 Finding of Violation (FOV) which EPA issued to the facility and/or to steps that the company could have been expected to take in response to the FOV, we find that the notice has not established that the violations reported have met a number of conditions of the EPAs Incentives for Self-Policing: Discovery, Disclosure, Correction and Prevention of Violations (Audit Policy), including conditions 1, 2, 4, and 7. In our upcoming discussions with the facilitys compliance with the Clean Air Act, we will also discuss the steps that they have taken, and will take, to remedy the violations disclosed in the notice.
