Case summary
System has to come into compliance with the MCL for combined radium-266 and radium-228, and in the interim must continue to sample for combined radium-226 and radium-228 during each quarter, and notify the public of the violation every 90 days. Elm Oak met the requirements of the Administrative Order by notifying U.S. EPA and Illinois EPA of its intention to comply with the Administrative Order, and providing a summary of steps taken to comply with the combined radium MCL and intended steps to achieve compliance with the Administrative Order. Elm Oak also sent U.S. EPA and Illinois EPA detailed plans for bringing the System into compliance with the combined radium MCL. Elm Oak applied for an Illinois EPA public water supply construction permit for installing ion exchange point of entry devices (water softeners) for radium remediation at twenty residences and Illinois EPA issued the permit on October 21, 2008. Elm Oak installed the point of entry devices in accordance with plans and specification approved by Illinois EPA and applied to Illinois EPA for an operating permit for radium remediation on November 11, 2009. On August 26, 2010, Elm Oak forwarded U.S. EPA a copy of the operating permit Illinois EPA issued for its radium remediation project on November 23, 2009. Illinois EPA returned Elm Oak to compliance with the Combined Radium MCL on January 13, 2012. Elm Oak also met the requirements of the Administrative Order by continuing to monitor quarterly for Combined Radium and reporting results to Illinois EPA, and providing public notice every three months until Illinois EPA retuned Elm Oak to compliance for Combined Radium in January 2012.
