Case summary

A compliance evaluation inspection (CEI) was conducted at the installation on December 11, 2004. US EPA issued two information requests to the installation, as well as a notice of violation (NOV). Violations observed and documented both during the CEI and subsequently included failure to produce a tank assessment for its hazardous waste storage tank; failure to update and maintain contingency plan; failure to comply with hazardous waste training requirements; and failure to properly prepare manifests. A pre-filing notice and opportunity to confer letter was issued on August 22, 2006, and a show-cause meeting was held with installation personnel on September 25, 2006. Based on the aforementioned documentation of violations, and on information offered during the show-cause meeting, Region 5 filed an Administrative Complaint on September 28, 2006.
