Case summary
SCO Industries, Inc. (OSCO) owns and operates two grey iron foundries located in Jackson and Portsmouth, Ohio. These facilities are operating grey iron cupolas subject to the Ohio State Implementation Plan (SIP) and the Clean Air Act (CAA). On December 1, 2003, U.S. EPA, Region 5 issued a Finding of Violation (FOV) and a Notice of Violation (NOV) to OSCO for alleged violations at its Portsmouth and Jackson, Ohio facilities. Specifically, U.S. EPA determined that OSCO had violated the Prevention of Significant Deterioration requirements in Part C of the Clean Air Act, 42 U.S.C. ���� 7470-7479 and 42 U.S.C. ���� 7491-7492, Sections 502 and 503 of the Clean Air Act, 42 U.S.C. ���� 7661a-7661b, and the Ohio SIP. U.S. EPA, Region 5, issued an additional Notice of Violation on April 26, 2005 to OSCO for alleged violations at its Portsmouth and Jackson, Ohio facilities. Specifically, U.S. EPA determined that OSCO had violated the Ohio SIP by failing to burn carbon monoxide gases generated during the operation of the grey iron cupola at 1,300 degrees Fahrenheit or greater in a direct-flame afterburner or equivalent device. The ACO requires OSCO to submit a Permit to Install (PTI) application requesting specific emission limits for PM and CO for the cupola stacks. It also requires OSCO to conduct a PM10 emissions test and determine a PM10 emission limit from the results of the stack test and request that limit in the PTI application. In its PTI application, OSCO will also request production limitations and hours of operation limitations for the cupolas, as well as, various terms and conditions to minimize emissions of CO from the cupolas and ensure compliance with the Ohio SIP.
