Case summary
Checkmate Boats, Inc. (Checkmate) owns and operates a boat manufacturing facility in Bucyrus, Ohio. Checkmate�s facility was constructed in the 1960s and is an existing source that is subject to the NESHAP for Boat Manufacturing. On May 26, 2005, U.S. EPA, Region 5 issued a Finding of Violation (FOV) to Checkmate for alleged violations at Bucyrus, Ohio facility. Specifically, U.S. EPA determined that Checkmate had violated Sections 112 of the Clean Air Act, 42 U.S.C. � 7401 et seq. and the NESHAP for Boat Manufacturing at 40 C.F.R. Part 63, Subpart VVVV, by failing to maintain records and failing to comply with the HAP limits listed in the NESHAP. The Administrative Compliance Order (ACO) requires Checkmate to demonstrate and maintain compliance with the NESHAP. Checkmate will ensure that all resins and gel coats used in the facility comply with the organic HAP emission limits listed in the NESHAP. The ACO also requires Checkmate to maintain applicable records and submit applicable reports required by the NESHAP.
