Case summary

U.S. EPA Region 5 recently issued an Administrative Penalty Order (APO) to Holland Terminal, Inc. (Holland Terminal). On November 2, 2005, U.S. EPA issued an Amended Notice of Violation to Holland Terminal for violations of the Michigan State Implementation Plan (SIP). Specifically, Holland Terminal, a bulk petroleum distribution terminal, failed to 1) maintain and operate its air pollution control system in a satisfactory manner, in violation of R336.1910 of the Michigan SIP, and 2) maintain its gasoline storage tanks such that all openings on the tanks are equipped with covers, lids, orseals such that the cover, lid, or seal is in the closed position at all times, except when in actual use, in violation of R336.1604(2)(a) of the Michigan SIP.
