Case summary

On May 29, 1999, the U.S. Corps of Engineers issued to Charles W. Owen a Section 404 permit authorizing a discharge of dredged and fill materials into 4.2 acres of wetlands. The permit required Mr. Owen to preserve in perpetuity an additional 4.3 acres of wetlands adjacent to a tributary of Buckeye Lake. In February 2005, the Corps identified that Mr. Owen discharged dredged and fill materials into the 4.3 acres of wetlands he was to preserve, without a Section 404 permit. The Compliance Order issued by U.S.EPA requires full restoration of the violation.
