From around October 2000 to June 2004, the Respondent had not determined if its approximately 48 generated waste paint filters, that exceeded the regulatory limit for barium, were hazardous or non-hazardous waste. The Respondent had changed their ingredients and color of their paint primer which should have led to a re-characterization of the spent paint filters. The filters that were spent containing the previous paint primers before October of 2000 were tested as non-hazardous for barium.
