Case summary

On November 4, 2004, U.S. EPA issued an Order Requiring Monitoring, Testing, Analysis and Reporting proceeding under the authority of Section 3013 of the Resource Conservation and Recovery Act (RCRA) to the Scio Pottery Company, Scio, Ohio. This order requires Scio to fully determine the extent of lead contamination from an inactive surface impoundment located on-site. Scio Pottery formerly manufactured ceramic dinnerware; although the buildings are used for storage of merchandise. The company has been cited for the operation of a hazardous waste land disposal unit (the surface impoundment) without a RCRA permit. Scio Pottery has occasionally sampled soil and ground water around the unit. However, U.S. EPA and the State of Ohio have been unable to convince the company to perform a full investigation and corrective action at the surface impoundment. The issuance of this 3013 order should enable Scio Pottery or U.S. EPA to gather sufficient information on the contamination to determine the future course of action with the facility.
