EPA v. SAINT GOBAIN CONTAINERS (4) (NATIONAL CASE)

Case summary

Region 5 participated in a global New Source Review (NSR) settlement with Ardagh Glass (formerly St. Gobain) which resulted in a Consent Decree (CD) in April of 2010. A component of the CD included a requirement for Ardagh to install a Best Available Technology (BACT) level NOx control technology on their Lincoln, Illinois glass furnace by December 2018. On November 7, 2018, Ardagh informed EPA that they will permanently cease operation of the Lincoln plant and requested a six month extension to the December 2018 compliance date to allow for an orderly cessation of operations while meeting consumer expectations. The CD modification requires Ardagh to partially offset excess emissions caused by the delay by performing environmental projects in Illinois to reduce NOx emissions. The modification also provides that, within one year of entry, Ardagh will implement $255,000 worth of environmental projects within the State of Illinois. By April 2021, the emission reductions due to the plant shutdown will have fully offset the excess NOx emitted due to the operation of the plant without the NOx controls between December 31, 2018 and June 30, 2019 and will thereafter continue to benefit the environment and health of the surrounding community.
