Case summary

An Administrative Order was issued to Superior Aluminum Alloys (Superior), New Haven, Indiana, requiring Superior to conduct performance testing pursuant to the National Emissions Standards for Hazardous Air Pollutants (NESHAP) for Secondary Aluminum at Furnace #3 by July 30, 2005. Superior started operating Furnace #3 on September 27, 2004, and under Subpart RRR was required to performance test the furnace on or before December 26, 2004. The Indiana Department of Environmental Management (IDEM) issued Superior a Significant Source Modification Permit on September 17, 2004, requiring performance testing on or before March 27, 2005. In November 2004, Superior requested to delay the performance testing of Furnace #3 beyond March 27, 2005, due to adverse weather conditions in March. Neither U.S. EPA nor IDEM has the authority to grant a request for delayed performance testing. This Order resolves the late testing violation by requiring Superior to test by July 30, 2005, and submit all related reports and notification according to deadlines determined by the July test date.
