The CAFO proposes as settlement for violations of filling of approximately 28.72 acres of wetlands in the Grand River watershed located adjacent to tributaries of Black Brook Creek, Grand River, Mentor Marsh and Lake Erie in Lake County, Ohio. The CAFO provides the following environmental benefits: (a) purchase of a 340-acre mitigation site within the Grand River watershed; (b) restoration and enhancement of 67 acres of wetlands on the mitigation site, including a 23 acre SEP; (c) an agreement by unrelated third parties to restore and enhance 71 acres of additional wetlands on the mitigation site; (d) donation of the entire 340-acre mitigation site to the Lake County (Ohio) Metro Parks for conservation, management and protection, in perpetuity; and, (e) agreement to obtain a lawful Section 404 permit. In addition to a administrative civil penalty of $75,000, the CAFO contains supplemental environmental project requiring the donation of the 340 acre mitigation site to Lake County MetroParks.
