Case summary

On December 18, 2002, the Wayne County Department of Environment conducted a multi media screening inspection at Sterling Services, Ltd. As part of the inspection, it was determined that the facility had large volumes of oil products and that the facility had not submitted the Emergency and Hazardous Chemical Inventory form to the State Emergency Response Commission (SERC), the Local Emergency Planning Committee, or the local fire department. In their response to an information request, the facility indicated that it had submitted the 2000, 2001, and 2002 calendar year forms on March 11, 2004, March 16, 2004 and March 23, 2004. Based on a conversation on April 13, 2004, with the SERC, the U.S. EPA determined that the SERC never received forms from the facility. The facility is claiming that it never received the information to submit. The SERC contends that it had mailed compliance assistance information to the facility. Within three miles of this site are 146,475 African-Americans persons are living. This is about 78.53 percent of the population around the site.
