Case summary

Based on a USEPA inspection on June 27, 2003, it was determined that QMA failed to: keep an accumulation container closed; certify the integrity of a hazardous waste storage system; provide hazardous waste training for employees; have a complete contingency plan; submit annual reports for calendar years 1999, 2000, 2002 and 2002; and prevent and minimize releases. The reductions in Item #32 were estimated based on the amount of mismanaged hazardous waste that was identified during the USEPA inspection. Specifically: one bag storing one cubic yard of filter cake (F006) was open and a 3,000 gallon tank storing corrosive hazardous waste (D002) was not certified. Assuming the worst case scenario, the mismanagement of the hazardous waste could have resulted in a potential release of one cubic yard of F006 and 3,000 gallons of D002 hazardous waste. On September 29, 2004 , Region 5 filed an Administrative Complaint and Compliance Order against QMA, Incorporated (QMA) at the Addison, Illinois facility. The Region alleged that QMA was storing hazardous waste without a permit or interim status; not keeping an accumulation container closed; not having certification of a hazardous waste tank storage system; not providing hazardous waste training for employees; not having a complete contingency plan; and failing to prevent and minimize releases. U.S. EPA is filing a civil complaint against QMA and seeking $233,803.00 in fines.
