Case summary
On September 29, 2004, Region 5 filed an Administrative Complaint against Rollprint Packaging Inc., 320 South Stewart Avenue and 335 South Stewart Avenue, Addison, Illinois. The Administrative Complaint alleges that the company violated State law by failing to 1) keep satellite accumulation containers containing hazardous waste closed when not in use; 2) minimize the possibility of fire, explosion or release; 3) post the emergency coordinator?s name and telephone number next to the telephone; 4) post the location of the fire extinguishers and spill control equipment next to the telephone; and 5) file the proper permit application for a hazardous waste storage permit within 30 days after its first noncompliance with any condition for an exemption from a permit, in 35 IAC ? 722.134. The Complaint proposes a civil penalty of $27,665. Based on information provided by Rollprint during facility inspections conducted by US EPA on 10/30/02 and 7/14/03, and Rollprint's submittal of documents in response to an Information Request and a pre-filing meeting, it was determined that Rollprint failed to comply with certain regulations of RCRA. Rollprint failed to keep several satellite accumulation containers closed, failed to minimize the possibility of fire, explosion or release which could threaten human health or the environment, failed to post the emergency coordinator's name and telephone number, and location of the fire extinguisher and spill control equipment, next to the telephone at 335 South Stewart Ave, and failed to obtain a permit in order to treat, store, or dispose of hazardous waste. These actions violated regulations promulgated at Title 35 of the Illinois Administrative Code, Parts 702, 703, 722 and 725. US EPA filed an Administrative Complaint and Compliance Order in this matter on 9/29/04. After Rollprint met with the US EPA, Rollprint and US EPA agreed to settle the case. [Note: The quantitative environmental impact listed above is an estimate based on the amount of satellite containers that were open during the time of the inspections. If the 7 drums, that were open, contained 55 gallons of solvents and if they all spilled, then 385 gallons would be released.]
