Case summary

On July 5, 2003, PCS Nitrogen Ohio, L.P. had an 81-pound release of oxides of nitrogen above their permitted limit. Oxides of Nitrogen is a CERCLA hazardous substance with a ten-pound RQ. This release was eight times the RQ. On October 8, 2003, PCS Nitrogen Ohio, L.P. submitted a notice of potential violations of CERCLA Section 103 and EPCRA Section 304 under the Self Disclosure Policy. BP Chemicals as the Agent for PCS Nitrogen Ohio, L.P. notified the NRC on April 15, 2005 or nine months and ten days after the release and more than 60 days after the notification under the Self Audit Policy.
