EPA v. Griffith Laboratories

Case summary

U.S. EPA conducted an inspection of Griffith Labs 9/9/2003. In response to numerous citizen complaints received by U.S. EPA and the Chicago Department of Environment, U.S. EPA issued a 114 to investigate Griffith's operations. As the 114 was in the process of being issued, Griffith began to plan the installation of a RTO to control odors emitted from their spray drying process. On 1/26/2004 U.S. EPA issued a NOV to Griffith alleging violation of Illinois Pollution Control Board Rule 102 for threatening or allowing the discharge or emission of contaminants into the air which tend to cause air pollution. Griffith, IEPA, and U.S. EPA began discussions concerning the installation and operation of the RTO that was to be installed to control Griffith's hydrolyzed vegetable protein manufacturing process. Once an agreement was reached, the terms and associated timeline were memorialized in an Administrative Consent Order. Since no emission violations were established, and compliance with Illinois PCB Rule 102 is achieved with the installation and operation of the RTO, no penalties will be assessed.
