Case summary

Sunset View Resorts Wetland Restoration: On April 30, 2003, U.S. EPA approved a supplemental wetlands restoration plan and concluded a Section 404 enforcement action brought against Mr. Thomas Hammerlund, Sr. and Sunset View Resorts, Itasca County, Minnesota. The initial Compliance Order issued in May 2002 alleged that dredged and fill materials had been discharged into wetlands, adjacent to Lake Winnibigoshish, without a Federal permit. The additional wetlands restored of 0.9 acres, brings the total wetlands restoration to 5.72 acres. The remaining 3.69 acres wetlands not restored will be compensated through a combined mitigation proposal of approximately 25 acres of other wetlands restoration, including replacement, preservation and upland buffer. A public notice will be issued by the U.S. Army Corps of Engineers (Corps) which will propose the Federal permit, along with other authorizations proposed by Sunset View Resorts.
