Case summary
FIFRA NOW: 10/21/2026 Middle Tennessee Envirosafe dba Chemstation of Tennessee Notice of Warning for Violations of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) Case File No. FIFRA-04-2026-8502 The U.S. Environmental Protection Agency regulates the registration, distribution, sale, and use of pesticide products pursuant to the provisions of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA or the Act), as amended, 7 U.S.C. 136 et seq. The EPA is issuing this Notice of Warning (NOW) to Middle Tennessee Envirosafe, LLC dba Chemstation of Tennessee (hereinafter, Middle Tennessee Envirosafe), pursuant to section 14(a)(4) of FIFRA. As explained below, the EPA finds that Middle Tennessee Envirosafe violated FIFRA section 12(a)(1)(E) by distributing or selling misbranded pesticides. On or about June 3, 2026, an authorized inspector of the EPA inspected at Middle Tennessee Envirosafe (EPA Est. No. 102617-TN-1) located at 1405 Heil Quaker Boulevard, LaVergne, Tennessee 37086. During the inspection, the inspector collected labels for Chemsan (EPA Reg. No. 103470-1) in a 5-gallon container, 275-gallon container and another container with a blank volume. Sales and distribution records were collected during the inspection demonstrate that Chemsan was distributed on one or more occasions between June and July 2026. Upon review of the labels collected during the inspection for Chemsan, it was found that the labels did not match the most recent EPA-approved label from January 29, 2025. Specifically, all three of the labels collected, included Manufactured by: Chemstation Buyers Association, Inc. 3400 Encrete Lane, Dayton, OH 45439-1946 and the 5-gallon and 275-gallon containers included EPA Establishment number 65072-OH-5 . This product was produced at Middle Tennessee Envirosafe (EPA Est. No. 102617-TN-1), making the products misbranded. Pursuant to FIFRA Section 2(q)(1)(D), a pesticide is misbranded if its label does not bear the establishment number assigned under Section 7 to each establishment in which it was produced. Pursuant to FIFRA Section 2(q)(1)(C)(i), a pesticide is misbranded if its label does not bear the name and address of the producer, registrant or person for whom produced. Pursuant to Section 2(q)(1)(F) of FIFRA, 7 U.S.C. 136(q)(1)(F), a pesticide is misbranded if the labeling accompanying it does not contain all directions for use which that are necessary for effecting the purpose for which the product is intended and that, if complied with, together with any requirements imposed under Section 3(d) of FIFRA, 7 U.S.C. 136a(d), are adequate to protect health and the environment.
