SEPTEMBER 30, 2026 - CONSENT AGREEMENT On May 13, 2026, pursuant to its authority under Section 11 of TSCA, 15 U.S.C. ? 2610, an EPA inspector conducted an inspection of Respondent?s worksite located at 1531 Carr Avenue, Memphis,Tennessee 38104 (the Property) where Respondent conducted ?renovations,? as defined at 40 C.F.R. ? 745.83, for compensation. The Property was constructed before 1978 and is ?target housing? as defined at 40 C.F.R.? 745.103. During the inspection, the EPA inspector observed that waste that had been collected from renovation activities was not stored under containment, in an enclosure, or behind a barrier that would prevent release of dust and debris out of the work area or prevent access to dust and debris. Subsequent to the inspection, on May 13, 2026, the EPA requested that Respondent provide records to the EPA inspector regarding its compliance with 40 C.F.R. Part 745, Subpart E. At the time of the inspection, and subsequent to the inspection, Respondent was unable to provide records to the inspector documenting that prior to performing renovation work at the Property, Respondent had: a. Obtained ?firm certification? as required by 40 C.F.R. ?? 745.81(a)(2)(ii) and 745.89(a)(1); and b. Provided the owner of the target housing with an EPA-approved pamphlet as required by 40 C.F.R. ? 745.84(a)(1). Respondent consents to the payment of a civil penalty, which was calculated in accordance with the Act, in the amount of THREE THOUSAND DOLLARS ($3,000.00), which is to be paid within thirty (30) days of the Effective Date of this CAFO.
