SEPTEMBER 29, 2026 - CONSENT AGREEMENT On June 24, 2025, an inspector with the EPA conducted an inspection at Respondent's place of business located at 1724 Ribaut Road, Port Royal, South Carolina 29935, for the purpose of evaluating Respondent's compliance with the requirements of 40 C.F.R. Part 745, Subpart F. During the inspection, the inspector requested copies of Respondent's records to evaluate Respondent's compliance with 40 C.F.R. Part 745, Subpart F. On June 27, 2025, Respondent submitted records via email to the EPA for review. After review of Respondent's records, the EPA determined that Respondent had entered into contracts to lease the residential dwellings that are target housing at the following locations (the Properties) on the specified dates listed below: a. 2901 Fourth Street, Beaufort, South Carolina 29902, built in 1956, lease entered into on February 14, 2025; b. 801 Washington Street, Beaufort, South Carolina 29902, built in 1965, lease entered into on May 8, 2023; and c. 1603A Hogarth Street, Beaufort, South Carolina 29902 built in 1964, lease entered into on June 6, 2022. At the time of the inspection, and subsequent to the inspection, Respondent was unable to provide records or otherwise demonstrate to the inspector that prior to entering into the leases with the lessees for the Properties, Respondent had, in its capacity as agent on behalf of the lessor: a. Included as an attachment or within the language of each lease contract a statement by the lessor disclosing the presence of known lead-based paint and/or lead-based paint hazards in the target housing being leased or indicating no knowledge of the presence of lead-based paint and/or lead-based paint hazards, as required by 40 C.F.R. ? 745.113(b){2); and b. Included as an attachment or within the language of each lease contract a statement by the lessee affirming receipt of the information required under 40 C.F.R. ? 745.113(b)(2), as required by 40 C.F.R. ? 745.113(b)(4). Respondent consents to pay a civil penalty, which was calculated in accordance with the Act, in the amount of TWO THOUSAND EIGHT HUNDRED FORTY-FIVE DOLLARS ($2,845.00), which shall be paid within thirty (30) days of the Effective Date of this CAFO.
