Case summary

SEPTEMBER 14, 2026 - CONSENT AGREEMENT On March 11, 2025, an inspector with the EPA conducted an inspection at Respondent's place of business located at 10535 Two Notch Road, Suite 3, Elgin, South Carolina 29045, for the purpose of evaluating Respondent's compliance with the requirements of 40 C.F.R. Part 745, Subpart F. Subsequent to the inspection, the inspector requested copies of Respondent's records to evaluate Respondent's compliance with 40 C.F.R. Part 745, Subpart F. On March 26, 2025, Respondent submitted records to the EPA for review. After review of Respondent's records, the EPA determined that Respondent had entered into contracts to lease the residential dwellings that are target housing at the following locations (the Properties) on the specified dates listed below: a) 435 Pineneedle Road, Columbia, South Carolina 29203, built in 1948, lease entered into on March 1, 2025; b) 12 Andrews Street, Sumter, South Carolina 29150, built in 1931, lease entered into on February 1, 2025; c) 3624-B Live Oak Street, Columbia, South Carolina 29205, built in 1966, lease entered into on October 20, 2024; d) 3510 Truman Street, Columbia, South Carolina 29204, built in 1955, lease entered into on October 1, 2024; e) 1523 Marley Drive, Columbia, South Carolina 29210, built in 1954, lease entered into on June 17, 2024; and f) 3508 Traveler Lane, Columbia, South Carolina 29209, built in 1969, lease entered into on April 9, 2024. During the inspection, and subsequent to the inspection, Respondent was unable to provide records to the inspector documenting that prior to entering into the leases with the lessees for the Properties, Respondent had included as an attachment or within the language of each lease contract, the information required under 40 C.F.R. ? 745.113(b)(l)-(6). The EPA determined that after entering into the contracts to lease the Properties, Respondent did not retain a copy of the completed attachments or lease contracts containing the information required under 40 C.F.R. ? 745.113(b) for no less than three (3) years from the commencement of the leasing periods, as required by 40 C.F.R. ? 745.113(c)(l). Based on the EPA's review of Respondent's records as set forth above, the EPA alleges that Respondent failed to retain a copy of the completed attachments or lease contracts containing the information required under 40 C.F.R. ? 745.113(b) for no less than three (3) years from the commencement of the leasing periods, in violation of 40 C.F.R. ? 745.113(c)(l). Respondent consents to pay a civil penalty, which was calculated in accordance with the Act, in the amount of ONE THOUSAND ONE HUNDRED DOLLARS ($1,100.00), which shall be paid within thirty (30) days of the Effective Date of this CAFO.
