MAY 13, 2026 - CONSENT AGREEMENT On October 17, 2025, the EPA received information about Respondent's management of a property located at 48 Wilshire Heights Drive, Crossville, Tennessee 38558. The EPA requested additional information from Respondent in order to evaluate Respondent's compliance with the requirements of 40 C.F.R. Part 745, Subpart F with respect to the property. On January 14, 2026, Respondent submitted records to the EPA for review to evaluate its compliance with 40 C.F.R. Part 745, Subpart F. Based on the EPA's review of the information received, and the records submitted by Respondent, the EPA determined that on or about June 30, 2025, Respondent entered into a contract to lease the residential dwelling located at 48 Wilshire Heights Drive, Crossville, Tennessee 38558, that was built in 1972, and is (/target housing, as defined in 40 C.F.R. ? 745.103. Based on the information and records the EPA received, Respondent was not able to demonstrate that the contract to lease the target housing referenced in the previous paragraph had included as an attachment or within the contract: a. the appropriate Lead Warning Statement, as required by 40 C.F.R. ? 745.113(b){l); b. a statement by the lessor disclosing the presence of known lead-based paint and/or lead-based paint hazards in the target housing being leased or indicating no knowledge of the presence of lead-based paint and/or lead-based paint hazards, as required by 40 C.F.R. ? 745.113(b)(2); and c. a statement by the lessee affirming receipt of the information required under 40 C.F.R. ? 745.113(b)(2) and the lead hazard pamphlet required under 15 U.S.C. ? 2686, in accordance with 40 C.F.R. ? 745.113(b)(4). Based on the information and records the EPA received, as set forth in Section IV above, the EPA alleges that at the time of entering into a contract for lease of a residential dwelling of target housing, Respondent failed to include as an attachment or within the contract: a. the appropriate Lead Warning Statement, in violation of 40 C.F.R. ? 745.113(b)(l); b. a statement by the lessor disclosing the presence of known lead-based paint and/or lead-based paint hazards in the target housing being leased or indicating no knowledge of the presence of lead-based paint and/or lead-based paint hazards in violation of 40 C.F.R. ? 745.113(b)(2); and c. a statement by the lessee affirming receipt of the information required under 40 C.F.R. ? 745.113(b)(2) and the lead hazard pamphlet required under 15 U.S.C. ? 2686, in violation of 40 C.F.R. ? 745.113(b)(4). Respondent consents to pay a civil penalty, which was calculated in accordance with the Act, in the amount of FOUR THOUSAND DOLLARS ($4,000.00), which shall be paid within thirty (30) days of the Effective Date of this CAFO.
