Notice of Warning for Violations of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) Case File No. FIFRA-04-2026-3998 The U.S. Environmental Protection Agency regulates the registration, distribution, sale, and use of pesticide products pursuant to the provisions of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA or the Act), as amended, 7 U.S.C. 136 et seq. The EPA is issuing this Notice of Warning (NOW) to Southeastern Tank, Inc. dba Solutions by SET (hereinafter SET), pursuant to Section 14(a)(4) of FIFRA, 7 U.S.C. 136l(a)(4). As explained below, the EPA finds that SET violated FIFRA section 12(a)(1)(E) by distributing or selling misbranded pesticides. On or around June 30, 2026, the Tennessee Department of Agriculture conducted an inspection at SET's facility at 914 North Main Street, Loretto, Tennessee 38469 (EPA Est. No. 103776-TN-1). As part of the inspection, EPA representatives photographed labels for a product marked SET-12.5% Sodium Hypochlorite Solution. In addition, EPA representatives collected sales or distribution records for the product marked SET-12.5% Sodium Hypochlorite Solution. The labels and labeling observed were accurate representations of the labels placed on the finished products when they are distributed. On or around June 30, 2026, the Tennessee Department of Agriculture conducted an inspection at SET's facility at 914 North Main Street, Loretto, Tennessee 38469 (EPA Est. No. 103776-TN-1). As part of the inspection, EPA representatives photographed labels for a product marked SET-12.5% Sodium Hypochlorite Solution. In addition, EPA representatives collected sales or distribution records for the product marked SET-12.5% Sodium Hypochlorite Solution. The labels and labeling observed were accurate representations of the labels placed on the finished products when they are distributed. According to the EPA's Pesticide Product and Label System (PPLS), EPA registration number 82357-1 is registered for CG - 12.5% Sodium Hypochlorite Solution and is manufactured for or by Chemical Inc USA. The brand name SET-12.5% Sodium Hypochlorite Solution is registered to the distributor product 82357-1-103776 and is distributed by Solutions by SET. As such, the product marked SET-12.5% Sodium Hypochlorite Solution viewed during the inspection did not bear the correct EPA registration number as required by 40 CFR 156.10(a)(1)(iv). Pursuant to Section 2(q)(1)(C) of FIFRA, 7 U.S.C. 136(q)(1)(C), a pesticide is misbranded if it is an imitation of, or is offered for sale under the name of, another pesticide. The product marked SET-12.5% Sodium Hypochlorite Solution did not display a valid producing establishment registration number on the container as required by 40 CFR 156.10(f). Pursuant to Section 2(q)(1)(D) of FIFRA, 7 U.S.C. 136(q)(1)(D), a pesticide is misbranded if its label does not bear the registration number assigned under section 7 to each establishment in which it was produced. The product marked SET-12.5% Sodium Hypochlorite Solution did not display the net weight or measure of contents as required by 40 CFR 156.10(d). Pursuant to Section 2(q)(2)(C)(iii) of FIFRA, 7 U.S.C. 136(q)(2)(C)(iii), a pesticide is misbranded if there is not affixed to its container, a label that bears the net weight or measure of the content. Based on the inspection, the EPA believes the product marked SET-12.5% Sodium Hypochlorite Solution is a misbranded pesticide. As set forth in FIFRA Section 12(a)(1)(E), 7 U.S.C. 136j(a)(1)(E), it is unlawful to distribute or sell any pesticide that is misbranded.
