FIFRA NOW: 7/9/2026 The Buzz Skin LLC Notice of Warning for Violations of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) Case File No. FIFRA-04-2026-3985 The U.S. Environmental Protection Agency regulates the registration, distribution, sale, and use of pesticide products pursuant to the provisions of the Federal Insecticide, Fungicide, and Rodenticide Act {FIFRA or the Act), as amended, 7 U.S.C. ?? 136 et seq. The EPA is issuing this Notice of Warning (NOW) to The Buzz Skin LLC (hereinafter Buzz Skin), pursuant to Section 14(a)(4) of FIFRA, 7 U.S.C.? 136/(a)(4). As explained below, the EPA finds that Buzz Skin violated FIFRA section 12(a)(1)(A) by distributing or selling unregistered pesticides. On or around June 26, 2026, EPA Region 4 conducted a review of a website associated with Buzz Skin (thebuzzskin.com). The EPA noted that a number of products were identified as bug defying , including Palm, Hamptons, Nantucket, Jet Set, Cherry, St. Barth's, Vacay, Escape, Charleston, Beach, Y'all, Bahamas, Savannah, Rose, Lavender, Rose, Splash, Glazed, and Miami ( hereinafter List A), were marketed for sale with an add-to-cart and checkout feature. In addition, the EPA observed the following: A. The homepage for Buzz Skin identifies their products as bougie bug defense that repel insects. B. Pictures of the product labels for List A did not display the ingredients, nor did they display any producer information. Based on the observed claims, the products in List A are pesticides as defined under FIFRA Section 2(u), 7 U.S.C. ? 136(u) in that the products contain a substance or mixture of substances intended for preventing, destroying, repelling or mitigating any pest. For a product to be considered a minimum risk pesticide, it must meet the requirements set forth in Title 40 of the Code of Federal Regulation (C.F.R.)? 152.25(f). At the time of the website review, the products in List A were observed being offered for sale or distribution without being registered as pesticides with the EPA. As set forth in FIFRA Section 12(a)(l)(A), 7 U.S.C. ? 136j(a)(l)(A), it is unlawful to distribute or sell any pesticide that is not registered under FIFRA Section 3, except to the extent that distribution or sale otherwise has been authorized by the Administrator under FIFRA. Pursuant to FIFRA Section 14, 7 U.S.C. 136j, violations of FIFRA may result in civil or criminal penalties. Civil penalties may be assessed at $24,885 per violation, as updated for inflation. See 40 C.F.R. 19.4. However, the EPA has determined that a NOW, in lieu of a civil penalty action, is the appropriate response for the violations of FIFRA set forth above. This NOW only resolves Buzz Skin civil liability for the specific violations set forth above for the instances described in this NOW. The EPA has the right to institute further enforcement actions for any additional or continuing violations. Nothing in this NOW relieves Buzz Skin of its obligation to comply with all applicable provisions of FIFRA and other federal, state, and local laws and regulations. Nor shall it constitute a waiver, suspension, or modification of the requirements of FIFRA and any regulations promulgated thereunder.
