FIFRA NOW: 8/03/2026 Layer One Industries, LLC Notice of Warning for Violations of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) Case File No. FIFRA-04-2026-3979 The U.S. Environmental Protection Agency regulates the registration, distribution, sale, and use of pesticide products pursuant to the provisions of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA or the Act), as amended, 7 U.S.C. 136 et seq. The EPA is issuing this Notice of Warning (NOW) to Layer One Industries, LLC (hereinafter Layer One), pursuant to Section 14(a)(4) of FIFRA, 7 U.S.C. 136l(a)(4), which provides the EPA with the authority to issue a NOW. As explained below, the EPA finds that Layer One violated FIFRA Section 12(a)(1)(A) by distributing or selling unregistered pesticides. On or around December 15, 2025, the EPA reviewed the Layer One website located at https://layeroneindustries.com/ and various subpages of the Layer One website (collectively, the Website ). During the review of the Website, the EPA observed that the pesticide products ArthroSpray, ArthroCase Bed Bug Box Spring Cover, ArthroCase Bed Bug Mattress Cover, and ArthroPad were being offered for sale on the Website via an Add-to-Cart button. Based on the claims observed on the company's website, which is labeling, and claims made by Kyle Bullock, Layer One's ArthroSpray, ArthroCase Bed Bug Box Spring Cover, ArthroCase Bed Bug Mattress Cover, and ArthroPad are intended for preventing, destroying, repelling, or mitigating any pest. As such they are a pesticide and require registration pursuant to section 3 of FIFRA. Based on a review of the Pesticide Product and Label system, Layer One's ArthroSpray, ArthroCase Bed Bug Box Spring Cover, ArthroCase Bed Bug Mattress Cover, and ArthroPad. As such, Layer One's ArthroSpray, ArthroCase Bed Bug Box Spring Cover, ArthroCase Bed Bug Mattress Cover, and ArthroPad, which contain the active ingredient diatomaceous earth and are being advertised or otherwise offered for sale, are pesticides that are not registered under section 3 of FIFRA.
