FIFRA Notice of Warning Case File No. FIFRA-04-2026-3528 The U.S. Environmental Protection Agency regulates the registration, distribution, sale, and use of pesticide products pursuant to the provisions of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA or the Act), as amended, 7 U.S.C. ?? 136 et seq. The EPA is issuing this Notice of Warning (NOW} to Y.S., Inc. (hereinafter Y.S.}, pursuant to Section 14(a}(4} of FIFRA, 7 U.S.C. ? 136/(a}(4}, which provides the EPA with the authority to issue a NOW. As explained below, the EPA finds that Y.S. violated FIFRA Section 12(a)(l)(A) by distributing or selling an unregistered pesticide. Pursuant to Section 12(a)(l)(A) of FIFRA, 7 U.S.C. ? 136j(a)(l)(A), it is unlawful for any person in any State to distribute or sell to any person any pesticide that is not registered under section 3 or whose registration has been canceled or suspended, except to the extent that distribution or sale otherwise has been authorized by the Administrator under FIFRA.
